Terms of Service

These Terms of Service apply to your access to and use of the websites, applications, and other online products and services provided by VoilaPage. By clicking your consent (e.g. "Sign in") or by using our Services, you agree to these Terms.

Our Privacy Policy explains how we collect and use your information. By using our Services, you're agreeing to be bound by these Terms and our Privacy Policy. Please see our Privacy Policy for information about how we collect, use, share, and otherwise process information about you.

1. Description of Services

VoilaPage is an AI-powered website editing platform that allows business owners to clone their existing website, make it editable via AI-assisted chat, and deploy it on a custom subdomain. Our Services include website cloning, AI-powered content editing, hosting, and deployment.

VoilaPage also offers VoilaNote, an AI-powered review collection add-on. VoilaNote provides businesses with a branded review page and QR code that customers can scan to leave AI-assisted Google reviews. VoilaNote is a separately billed service available to any VoilaPage user.

2. Scope of Service

VoilaPage provides the following services: website hosting on a .voilapage.com subdomain (or custom domain), AI-powered content editing via chat, website design and rebuilding (as part of the setup service), domain transfer assistance, and SEO optimization.

VoilaNote provides the following services: branded review page with QR code, AI-powered review text generation based on customer ratings and feedback, scan and review analytics, and customizable review tags per business type. VoilaNote does not post reviews on behalf of users — the customer retains full control over what they publish on Google.

VoilaPage does NOT provide the following services: social media management (Instagram, Facebook, TikTok, etc.), Google Business profile management, marketing or advertising services, email marketing, graphic design services beyond the website, photography services, or full website redesigns via the AI editing tool (the AI tool is for incremental content changes only).

The AI editing tool is designed for targeted, incremental changes to your website: text updates, image replacements, menu changes, hours updates, price changes, banner additions, and contact information updates. It is not designed for structural redesigns or complex multi-page layout changes.

3. Setup Fee and Onboarding Service

VoilaPage offers a one-time setup service (currently priced at €399) that includes: custom website design and development, SEO optimization (page speed, mobile responsiveness, clean code, SSL), and domain transfer assistance (for Pro and Business plans).

The setup service is a professional service performed by the VoilaPage team. Estimated delivery time is 48 to 72 hours after payment.

The setup fee is separate from the monthly or annual subscription fee.

The customer may choose between a fresh, modern design (created from scratch by VoilaPage) or an adaptation of their existing design (if the customer confirms they own the rights to the design).

VoilaPage retains intellectual property rights over the website design created as part of the setup service, and grants the customer a perpetual, non-exclusive license to use the design for their business website.

The setup service includes up to two (2) rounds of revision feedback. During each round, the customer may request multiple changes. After both revision rounds have been completed, any further modifications to the website must be made by the customer using the self-service chat editing tool included in their subscription plan, or by purchasing additional editing credits. This limitation ensures efficient delivery and encourages customers to consolidate their feedback.

4. Your Account and Responsibilities

You're responsible for your use of the Services and any content you provide, including compliance with applicable laws. Content on the Services may be protected by others' intellectual property rights. Please don't copy, upload, download, or share content unless you have the right to do so.

You may need to register for an account to access some or all of our Services. Help us keep your account protected. Safeguard your password to the account, and keep your account information current. We recommend that you do not share your password with others.

If you're accepting these Terms and using the Services on behalf of someone else (such as another person or entity), you represent that you're authorized to do so, and in that case the words "you" or "your" in these Terms include that other person or entity.

To use our Services, you must be at least 18 years old.

If you use the Services to access, collect, or use personal information about other users ("Personal Information"), you agree to do so in compliance with applicable laws. You further agree not to sell any Personal Information.

5. Website Cloning and Content

When you use VoilaPage to clone a website, you represent and warrant that you own or have the legal right to reproduce and modify the content of the source website. VoilaPage is not responsible for verifying your ownership or rights to the source website content.

You retain ownership of the content you provide and the websites you create through our Services. However, by using our Services, you grant VoilaPage a limited license to host, store, reproduce, and display your content solely for the purpose of providing the Services.

6. AI-Generated Modifications

Our Services use artificial intelligence to edit and modify website content based on your instructions. While we strive for accuracy, AI modifications may not always produce perfect results. You are responsible for reviewing and approving all changes made to your website through our AI editing tools.

VoilaPage does not guarantee that AI-generated edits will be error-free, accurate, or suitable for your specific needs. You should review all changes before they are published.

The AI editing tool is designed for targeted, incremental changes to your website content. It is not a replacement for professional web design or development. Complex structural changes, multi-page redesigns, or changes requiring custom code may not produce satisfactory results. VoilaPage continuously improves its AI capabilities but cannot guarantee that all edits will be accurate, complete, or free of unintended side effects. You are responsible for reviewing all changes to your website before considering them final.

VoilaNote uses AI to generate review text based on customer ratings and selected tags. The generated text is a suggestion that the customer can edit before posting. VoilaPage does not post reviews on behalf of users and is not responsible for the content of reviews posted by users on Google or any other platform. The customer who scans the QR code is solely responsible for the review they choose to publish.

7. Hosting and Deployment

Websites created through VoilaPage are hosted on third-party infrastructure and deployed on a .voilapage.com subdomain. We make reasonable efforts to maintain uptime and availability, but we do not guarantee uninterrupted service. We reserve the right to remove or suspend any website that violates these Terms.

8. Subscription Plans and Billing

VoilaPage offers subscription plans (Starter, Pro, and Business) with different features and monthly edit limits. Plans are billed monthly or annually, as selected at the time of purchase.

In addition to website plans, VoilaPage offers VoilaNote as a separate paid add-on (currently €29/month or €290/year). VoilaNote subscriptions are billed independently from website plan subscriptions. The same cancellation, renewal, and billing policies apply to VoilaNote subscriptions.

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through the Stripe billing portal accessible from your dashboard. Cancellation takes effect at the end of the current billing period — you retain full access to your plan features until then.

After cancellation, your website remains live and accessible on its voilapage.com subdomain, but editing capabilities are disabled. If you had a custom domain, traffic will be redirected to your voilapage.com subdomain.

We reserve the right to change our pricing with 30 days' notice. Price changes do not affect your current billing period.

All payments are processed securely by Stripe. VoilaPage does not store your payment card details.

New subscribers are eligible for a "satisfied or refunded" guarantee: if you are not satisfied with the service, you may request a full refund within 30 days of your first payment. This guarantee applies to the first billing period only and must be requested by contacting us at fabien@voilapage.com. See our Refund Policy for full details.

9. Prohibited Uses

You may not use our Services to:

  • Clone or reproduce websites you do not own or have authorization to copy
  • Create websites containing illegal, harmful, or offensive content
  • Infringe on the intellectual property rights of others
  • Distribute malware, spam, or other malicious content through your hosted website
  • Attempt to circumvent usage limits or rate limits
  • Use the AI editing features to generate content that violates applicable laws
  • Use VoilaNote to generate or facilitate fake, misleading, or incentivized reviews in violation of Google's review policies or applicable laws

10. Termination

You're free to stop using our Services at any time. We reserve the right to suspend or terminate your access to the Services with or without notice, particularly if we believe you have violated these Terms.

11. Transfer and Processing Data

In order for us to provide our Services, you agree that we may process, transfer, and store information about you in France and other countries where our service providers operate, where you may not have the same rights and protections as you do under local law.

12. Disclaimers — Service is "As Is"

We aim to give you great Services, but there are some things we can't guarantee. Your use of our Services is at your sole risk. You understand that our Services and any content generated or hosted through the Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

In particular, we do not warrant that AI-generated edits will be accurate, complete, or suitable for your business needs. No advice or information obtained from us or through the Services will create any warranty not expressly made in this paragraph.

13. Limitation of Liability

We don't exclude or limit our liability to you where it would be illegal to do so; this includes any liability for gross negligence, fraud, or intentional misconduct in providing the Services.

Where exclusions or limitations of liability are allowed:

  • We won't be liable for any indirect, consequential, exemplary, incidental, punitive, or special damages, or any loss of use, data, or profits, under any legal theory, even if we have been advised of the possibility of such damages.
  • We limit total liability for any claim arising out of or relating to these Terms or our Services to the total amount paid by you to VoilaPage in the 12 months preceding the event giving rise to the claim, including any setup fees.

14. Amendments

We may make changes to these Terms from time to time. If we make changes, we'll provide you with notice by sending an email to the email address associated with your account or by updating the date at the top of these Terms. Unless we say otherwise, the amended Terms will be effective immediately, and your continued use of our Services after we provide such notice will confirm your acceptance of the changes. If you don't agree to the amended Terms, you must stop using our Services.

15. Right of Withdrawal (Droit de Rétractation)

In accordance with Articles L221-18 to L221-28 of the French Code de la consommation, you have the right to withdraw from your purchase within 14 calendar days without giving any reason.

For the setup service: if you expressly request that work begins before the 14-day withdrawal period expires (via the consent checkbox during checkout), you acknowledge that you will lose your right of withdrawal once the service has been fully performed. If you withdraw after work has begun but before completion, you may be charged a proportional amount for the work already performed.

For the subscription: you may exercise your withdrawal right within 14 days of the first payment. If you have used the editing service during this period, a proportional amount for the services consumed may be deducted from your refund.

To exercise your right of withdrawal, you must inform us by a clear, unambiguous statement sent to fabien@voilapage.com. You may use the following model withdrawal form, but it is not obligatory:

17. Force Majeure

Neither party shall be liable for any failure or delay in performing their obligations where such failure or delay results from circumstances beyond the reasonable control of that party, including but not limited to: natural disasters, government actions, internet or telecommunications failures, third-party service provider outages (hosting, AI services, code repositories, payment processors), cyberattacks, or pandemics.

18. Data Portability and Service Termination

Upon cancellation or termination of your subscription, you may request a full export of your website files by contacting fabien@voilapage.com.

Your website will remain accessible on its .voilapage.com subdomain for 90 days after the end of your subscription, after which it may be archived or deleted.

If you have a custom domain, we will assist you with transferring it away from our hosting upon request.

After the 90-day period, VoilaPage reserves the right to delete all associated data (website files, chat history, project settings).

19. Governing Law

These Terms are governed by and construed in accordance with French law. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.

20. Severability

If any provision or part of a provision of these Terms is unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
